Terms of Service

1. Acceptance of Terms

By accessing or using NeuroDesk ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. Continued use constitutes acceptance of any future amendments.

2. Services Description

NeuroDesk provides data science, machine learning, academic research and web development services. Each engagement is scoped individually. Service descriptions, pricing, and delivery timelines are confirmed in writing before work begins.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old to use the Platform.

4. Order Process

1. Submission: Submit project requirements through the order form or direct communication.
2. Quote: We provide a detailed quote including scope, price, and estimated timeline within 5-30 minutes of your brief.
3. Confirmation: You confirm acceptance of the quote. A 50% deposit is required to begin work.
4. Execution: Work proceeds per agreed milestones. Regular updates are provided.
5. Delivery: Final deliverables are provided upon completion and full payment.

5. Payment Terms

• Pricing is quoted in USD unless otherwise specified
• A 50% deposit is required before work commences
• The balance is due upon delivery of completed work
• Payments are processed securely through Stripe
• Refunds are handled per our Refund Policy (Section 8)

6. Project Revisions

Each service tier includes a specified number of revision rounds (typically 1–3). Revision requests must be submitted within 7 days of delivery. Additional revisions may incur extra charges. Minor corrections are always accommodated at no cost.

7. Intellectual Property

Deliverables: Upon full payment, you receive full ownership of the final deliverables. We retain the right to display completed work in our portfolio (excluding confidential or proprietary projects).

Pre-existing Materials: Any tools, libraries, or frameworks used in service delivery remain the property of their respective owners and are licensed, not sold.

8. Refund Policy

• Full refund: If we cannot deliver as agreed, you receive a full refund of all amounts paid.
• Partial refund: For partially completed projects, refunds are calculated based on work completed versus total scope.
• No refund: After final delivery and acceptance of deliverables.
• Refund requests must be submitted via email within 14 days of the issue arising.

9. Confidentiality

We treat all project information, data, and communications as confidential. Non-disclosure agreements (NDAs) are available on request and can be signed before any project details are shared.

10. Client Responsibilities

• Provide clear, complete project requirements
• Respond to queries and review deliverables within reasonable timeframes
• Provide necessary access to data, systems, or accounts required for the project
• Make timely payments per agreed terms
• Not use the Platform for illegal or unauthorized purposes

11. Limitation of Liability

NeuroDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or services. Our total liability is limited to the amount paid by you for the specific service giving rise to the claim.

12. Termination

We reserve the right to suspend or terminate accounts for violation of these terms, including but not limited to fraudulent activity, abusive behavior, or non-payment. You may terminate your account at any time by contacting us.

13. Dispute Resolution

Any disputes arising from these terms shall first be addressed through direct communication. If unresolved, disputes will be settled through binding arbitration in accordance with the laws of Kenya. Both parties agree to resolve issues in good faith before pursuing legal action.

14. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any legal actions shall be brought in the courts of Nairobi, Kenya.

15. Changes to Terms

We may modify these terms at any time. Changes are effective immediately upon posting. Registered users will be notified of material changes via email. Continued use after changes constitutes acceptance.
